General Terms and Conditions
1. Scope & Subject Matter
These General Terms and Conditions (GTC) apply to all contracts between JamOne – Adnan Schulze-Hüneke (hereinafter "Provider") and his customers who are entrepreneurs within the meaning of § 14 BGB (German Civil Code) (hereinafter "Customer").
The subject matter of the contract includes services in the field of AI visibility analysis (AI Presence Audit), Generative Engine Optimization (GEO), and the implementation of technical protection protocols (e.g., ECAP, HARP).
2. Conclusion of Contract & Mandate
A contract is concluded through the written acceptance of an individual offer or by booking a defined audit package via this website. For enterprise services, the engagement is carried out in the form of a specific mandate.
3. Services & Obligations to Cooperate
The Provider performs his services based on the current state of the art in the field of Large Language Models (LLM). The Customer acknowledges that the results of AI systems (e.g., ChatGPT, Claude) depend on external factors over which the Provider has no direct influence.
The Customer is obliged to provide all information and technical access (if necessary) required for the analysis in a timely manner.
4. Remuneration & Payment Terms
The prices stated in the offer or on the website shall apply. Initial Audits are, as expert opinions, generally subject to a fee and payable without deduction upon invoicing. All prices are subject to the applicable statutory value-added tax.
5. Copyright & Intellectual Property
All protocols developed by the Provider (ECAP, HARP), software engines (JamOne AI), and analysis methodologies remain the intellectual property of Adnan Schulze-Hüneke. The Customer is granted a right of use within the scope of the purpose of the contract. Any disclosure of methodological details to third parties is prohibited.
6. Liability
The Provider is liable for intent and gross negligence. For slight negligence, the Provider is only liable in the event of a breach of an essential contractual obligation (cardinal obligation). Liability for permanent placement in AI responses cannot be assumed, as the algorithms of the model providers are subject to constant, unannounced changes.
7. Final Provisions
The law of the Federal Republic of Germany shall apply. The place of jurisdiction for all disputes arising from this contract is, as far as legally permissible, the seat of the Provider (Schwülper/Braunschweig, Germany).
